Terms and Conditions
Last updated: 11th August 2026
These terms govern album design, printing, restoration and related services supplied by Bursill Albums, and the use of this website. Please read them before placing an order. They sit alongside my Privacy Policy, Cookie Policy, Copyright Notice, AI Use Statement and Disclaimer, and they do not affect your statutory rights as a consumer.
1. Who I am
Bursill Albums is a trading style of Bursill Images Limited, registered in England and Wales, company number 09017942, registered office S11, The Atkins Building, Lower Bond Street, Hinckley, Leicestershire, LE10 1QU.
In these terms, "I", "me" and "my" mean that company, and "you" means the person or organisation placing the order.
Correspondence and anything you need to send me by post should go to 71 Cliff Street, Rishton, Blackburn, Lancashire, BB1 4EE.
You can reach me at
You must be 18 or over to place an order. If you order on behalf of someone else — a company, a club, a family member — you confirm you have the authority to do so.
2. What these terms cover
These terms apply to every order I accept. Where you send me your own purchase order or standard conditions, those do not apply unless I have agreed to them in writing.
The contract between us is made up of these terms and the written quotation you accept, together with any information or statement that applicable consumer law treats as binding. If we agree any change to the specification or other contractual term after the quotation, I will confirm it in writing.
Nothing in these terms excludes or limits any right or remedy you have in relation to information, statements or representations that the law treats as part of our contract.
3. Quotations and how an order is formed
Prices shown on the website are indicative. A written quotation is valid for 30 days from its date and covers the specification recorded in it: the album, its size, page count, materials and finish.
A contract is formed when you accept a quotation in writing and pay the deposit. Until then, nothing is committed on either side, and I may decline an order without giving a reason. Where I decline, anything you have paid is returned in full.
If your requirements change after that point — a larger album, more pages, a different material — I will requote, and you can decide whether to proceed on the new figure.
Occasionally a price may be quoted wrongly because of an obvious error. Where the error is obvious and I tell you before work begins, I may correct it. I will tell you the correct price and you can decide whether to proceed or withdraw, in which case anything you have paid will be returned in full.
4. Prices and VAT
Prices quoted are the total amount payable. I am not currently registered for VAT, so no VAT is charged and none is recoverable on my invoices. If that position changes I will say so here, and any quotation you have already accepted will be honoured at the figure quoted.
The price quoted covers delivery to a single address in the United Kingdom. Delivery elsewhere is quoted separately, and section 9 explains how import duties and taxes are handled.
5. Deposit and payment
A deposit of 50% confirms the commission and secures a place in the schedule. The balance is due once you approve the album layout. Nothing goes to the manufacturer until the balance is paid.
Bank transfer is my preferred method, and the details are on every invoice. Card payments are also accepted, handled by Stripe; your card details are entered on their systems, not mine, and are never held by me.
For clubs, associations and companies I can work to purchase orders. Invoicing is in two stages: a deposit to confirm the commission, payable within 14 days, and the balance, which is payable before the books are dispatched.
Where an organisation is paying, the organisation is the customer under these terms, and the consumer provisions below do not apply. Section 20 sets out what changes.
The album remains my property until it has been paid for in full, even though it may already be in your hands. Risk passes to you on delivery, as section 9 explains.
6. What the price includes
The album price includes the design, the layout, the preparation of files for the specific paper and press, a digital proof, and two rounds of amends.
It does not include scanning, restoration or colourisation, which are quoted separately; RAW processing, retouching or image manipulation requested by you, which is also quoted separately; or additional copies, which are quoted alongside the main album.
7. Photographs and files you supply
You are responsible for supplying the photographs. By sending them, you confirm that you own the copyright or have the copyright owner's permission for the work to be reproduced by a third party on your behalf. This matters, and is set out in full in my Copyright Notice.
I may decline to proceed where I have reasonable grounds to doubt that the necessary permissions exist, and may ask for written confirmation from the photographer. Where I decline for that reason before work begins, your deposit is refunded in full.
If a third party makes a copyright claim because photographs or other material you supplied were provided in breach of the confirmation above, you are responsible, so far as the law allows, for the reasonable and direct loss and costs I incur as a result. I will take reasonable steps to reduce any loss, and I will not seek to recover any amount caused by my own act or omission. I will consult you before agreeing any settlement for which I intend to seek payment from you.
I will tell you honestly if the resolution or condition of the files you send is not adequate for the album you have asked for, before taking payment.
8. Proofing and amends
You receive a digital proof of every spread, viewed online. It is not a printed proof: producing a sample album would add both cost and several weeks to the schedule. The proof shows layout, sequence and content; it cannot show print quality, ink density or paper texture, and my Disclaimer explains why.
Two rounds of amends are included in the price. A round means all the changes you want, gathered and sent together. Further rounds after the second are chargeable, and I will quote for them before doing the work.
Nothing goes to the manufacturer until you approve the digital proof in writing. Approving the proof is what these terms mean by approving the album layout, and it is the point at which the balance falls due and after which the order can no longer be cancelled.
That approval is your confirmation that the content, spelling, names, dates and sequence are correct. I proofread what you send me and query anything that looks wrong, but the final check is yours. An error that was clearly shown in the digital proof you approved will not normally entitle you to a free remake, unless the error results from my failure to exercise reasonable care and skill or another statutory right applies.
9. Turnaround and delivery
Timescales quoted are estimates made in good faith, based on my workload and the manufacturer's production schedule. They are not guarantees, and they run from your approval of the album layout rather than from the date you first make contact.
If you have a fixed deadline, tell me at the outset, and I will tell you honestly whether it is achievable. Where a deadline has been agreed in writing, and I miss it through my own fault, talk to me, and I will put it right.
Delays genuinely caused by the manufacturer, courier or another event outside my reasonable control are dealt with under section 18. I am not responsible for the delay itself where it is outside my reasonable control, but this does not affect any statutory right you may have to cancel the contract or obtain a refund where applicable.
Albums are delivered by insured courier to a single address in the United Kingdom. Please make sure someone is there to receive the delivery. Risk passes to you on delivery. Please check the album on arrival and tell me as soon as reasonably possible, ideally within 14 days, if anything is damaged or missing. Reporting the problem later does not remove any statutory right you may have.
Delivery outside the UK can be arranged and is quoted separately. Any import duties, taxes or customs charges are yours to pay, and it is for you to check that what you are ordering can lawfully be imported into your country. I have no knowledge of, and no responsibility for, the law of any country other than the UK.
10. Physical prints you send me
Where you send original prints for scanning or restoration, I return them by tracked and insured delivery. I recommend you insure them on the outbound journey too, for their sentimental as well as their monetary value where that is possible.
I am not an archive service, so please keep your own copy of every digital file you send me. I will take reasonable care of files while they are in my possession, but I cannot be responsible for loss that could reasonably have been avoided by you keeping a backup, except to the extent that the loss results from my failure to exercise reasonable care and skill.
If I cannot return your originals because I have no reply to my messages, I will keep them safely and keep trying. I will not dispose of anybody's family photographs.
11. Your right to cancel
Albums and books are made to your specification and are clearly personalised. The statutory 14-day cancellation right that normally applies to distance sales of goods does not apply to those bespoke goods.
Design, restoration and colourisation work are services. If you want me to begin providing a service during the 14 days after our contract is made, you must expressly ask me to begin during that period.
If you exercise a statutory right to cancel after expressly asking me to begin a service during the cancellation period, you must pay only the proportionate amount lawfully due for the service supplied up to the time you cancel. If the service is fully performed during the cancellation period after your express request and acknowledgement that the cancellation right will then be lost, your statutory right to cancel that service ends when performance is complete.
In addition to your statutory rights, I offer the following cancellation arrangements for an album or book commission.
If you cancel before I begin design work, your deposit is refunded in full.
If you cancel after design work has started but before you approve the digital proof, I will refund your deposit less the proportionate value of the design work already performed and any reasonable, non-recoverable third-party cost incurred specifically for your commission. I will itemise any deduction. Where your cancellation falls within a statutory cancellation period, I will not deduct more than the amount the law permits.
Once you approve the digital proof in writing, the bespoke album or book is committed to production and I do not offer a contractual cancellation or refund merely because you change your mind. This does not affect your statutory rights if the goods or services are faulty or otherwise do not comply with the contract.
For restoration or colourisation work, you may ask me to stop before the work is completed. You will pay only for work already supplied or completed and any balance paid for work not yet supplied will be refunded, subject to the statutory rules above where the cancellation occurs during the 14-day cancellation period.
If your circumstances change, particularly because of illness, bereavement or another difficult event, please talk to me. Where practicable I would rather pause a commission than require you to continue immediately.
12. Commissions that go quiet
Occasionally a commission stalls because life gets in the way. That is not a problem, and there is no deadline by which you have to come back to me — but I do need to be able to close my books at some point.
If I have heard nothing from you for six months, I will write to you at the last email address and postal address you gave me. If I have had no reply 30 days after that, I may treat the commission as cancelled. Where that happens, I will refund your deposit less the design time already spent and any costs I have committed to, itemised as above, and I will tell you before I delete anything.
13. Faults and remakes
If the album arrives with a manufacturing fault, a binding defect, a printing error against the approved proof, or damage in transit, please tell me as soon as reasonably possible, ideally within 14 days, and I will have it remade at no cost to you where that is the appropriate remedy. Photographs of the fault help.
Variation in colour, grain and texture between batches of natural materials is a characteristic of those materials and not a fault, and printed pages are subject to normal commercial tolerances in colour, density and trim. My Disclaimer covers this in detail. If a particular finish matters to you, ask me before you commit and I will tell you honestly what to expect.
None of this affects your rights under the Consumer Rights Act 2015 to goods that are of satisfactory quality, fit for purpose and as described, or to services performed with reasonable care and skill.
14. Restoration and colourisation
Restoration is quoted per photograph after I have seen a scan, and the assessment is free. What can be achieved depends entirely on what survives in the original: damage can be repaired convincingly, but detail that no longer exists can only be reconstructed, and a reconstruction is an informed approximation rather than a recovery.
Colourisation is an interpretation, not a historical record. Where the true colours are unknown, I make informed choices based on the period and the subject.
I use AI tools in this work, under human review, as set out in my AI Use Statement. If you would prefer your photographs were worked on without them, say so at the outset and that can be arranged.
Where I do not believe a worthwhile result is achievable from the material supplied, I will tell you before taking payment.
15. Album design and ownership
The page layouts, sequencing and other original design work I produce remain my copyright, including changes and later versions made from them.
You have a perpetual, non-exclusive licence for your own private, non-commercial use to keep, enjoy and display the finished album and any finished design files I supply, and to make personal digital copies of those files. You may also order further physical copies through me.
This licence does not transfer ownership of my design copyright or permit commercial use or manufacture of the album design by another supplier without my written agreement. Those additional rights can usually be agreed separately — please ask.
16. How long I keep your files
Working files and photographs are held for 12 months after delivery so that reprints and additional copies can be produced without asking you to send everything again, then deleted unless you have asked in writing for them to be kept longer. My Privacy Policy sets out the detail.
17. Showing your album as an example
I will never publish your album, your photographs or your name without asking you first, and you are free to say no without it affecting anything. If you have given permission and later change your mind, tell me and I will take it down. You do not need to give a reason.
18. Things outside my control
I am not liable for delays or failures caused by events beyond my reasonable control, including manufacturer capacity and closures, courier failure, industrial action, fire, flood, power or network failure, or serious illness.
Where such an event occurs I will tell you promptly and agree a revised schedule, and where the delay is substantial you may cancel and receive a refund of any sums paid for work not yet done.
19. Liability
Nothing in these terms limits or excludes my liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be limited or excluded. Nothing in these terms affects your statutory rights.
If you are a consumer, I am responsible for loss that is a foreseeable result of my breach of these terms or my failure to exercise reasonable care and skill. I am not responsible for business losses suffered by a consumer.
Where you entrust original physical photographs or prints to me, I will take reasonable care of them. I do not accept liability for sentimental or emotional value that cannot reasonably be measured financially, but nothing in these terms excludes liability for physical loss or damage caused by my negligence or breach of contract.
If you are a business, club, association or other organisation, subject to the first paragraph above, my total liability arising from an order is limited to the price paid for that order, and I am not liable for indirect or consequential loss or for loss of profit, business or opportunity, in each case only to the extent permitted by law.
This section, and any other part of these terms that lawfully limits my liability, applies equally to anyone working with me on your commission, including a freelance designer, retoucher or contractor, and any of them may rely on it.
20. Business, club and organisation customers
Where the customer is a company, club, association or other organisation rather than a consumer, the following applies in place of the consumer provisions above.
There is no right to cancel under the Consumer Contracts Regulations, and the flexibility described in section 11 is offered at my discretion rather than as a term of the contract.
For organisations, the 50% deposit is payable within 14 days of the deposit invoice and, despite section 5, the balance is payable before the books are dispatched. I do not offer 30- or 60-day credit terms. If your organisation cannot work on that basis, please tell me at quotation stage rather than after the commission has started.
I reserve the right to charge interest and compensation on overdue sums under the Late Payment of Commercial Debts (Interest) Act 1998.
The album remains my property until paid for in full. Where an invoice remains unpaid, I may withhold further work and further copies.
The Consumer Rights Act protections referred to in section 13 do not apply, but I will still remake anything that arrives faulty, on the same basis.
Where you are a business, club, association or other organisation, you indemnify me against reasonable losses, liabilities and legal costs arising from a third-party copyright claim caused by your breach of section 7, except to the extent that the claim or loss was caused by my own act or omission.
21. Using this website
You are welcome to browse, read and print pages of this site for your own use. Please do not copy, republish or reuse the text, images or album designs on it for any other purpose without asking me. I will do my best to keep the site available, but I may need to take it down for maintenance without notice.
If you send me a message, an enquiry or files through this site, please make sure what you send is lawful, accurate and yours to send.
22. Complaints
If something has gone wrong, email
If we cannot settle it between us, I am willing to consider mediation through an appropriately accredited ADR provider. I am not currently required to participate in a particular ADR scheme.
23. Communication between us
I will normally contact you by email, at the address you gave me when you ordered. You agree that emails between us are as binding as a signed letter. Notices sent by post to the address on your order are treated as delivered within 72 hours of posting; emails are treated as delivered within 24 hours, unless the sender is told the message did not arrive.
Please tell me if your email address or postal address changes.
24. General
If any part of these terms turns out to be unenforceable, that part is reduced only as far as necessary to make it work, and the rest is unaffected.
If I do not insist on something at the time, that does not mean I have given up the right to insist on it later.
I may transfer my rights and obligations under these terms to another business, and I will tell you if that happens. It will not affect your rights. You may not transfer yours without my agreement, other than by giving the finished album to someone else.
Apart from the people named in section 19, nobody other than you and I has any right to enforce these terms.
Any obligation intended to continue after an order is completed does so.
25. Changes to these terms
I may update these terms from time to time. The version that applies to your order is the version in force on the date your quotation was accepted, and I will send you a copy on request.
26. Law and jurisdiction
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.
Annex — Notice of the right to cancel
This notice applies only where a statutory right to cancel exists. As section 11 explains, bespoke albums and books made to your specification or clearly personalised are excluded from the statutory cancellation right applicable to goods. Services such as design, restoration and colourisation may carry a 14-day cancellation right unless that right has ended in accordance with section 11.
Where the right does apply, you have 14 days from the day the contract was made (for services) or from the day you receive the goods (for goods) to cancel without giving a reason.
To cancel, tell me by a clear statement — an email to
If you cancel, I will refund what you have paid within 14 days of being told, using the same payment method you used, unless we agree otherwise. Where you expressly asked me to begin providing a service during the cancellation period, I may deduct only the proportionate amount lawfully due for the service supplied up to the time you cancelled.
